He provided an extensive letter pointing out the flaws in the report, including the fact that there was no data to prove the kratom was pure. Plus, the reports were given verbally, which can lead to accuracy and credibility issues.
If the bill is passed, the Virginia Board of Pharmacy will need to:
- Determine the number of issues linked to kratom within Virginia.
- The number of kratom buyers in Virginia.
- The benefits that kratom has to offer.
- Issues if kratom is added to the controlled substance list.
- How kratom should be scheduled if the Board of Pharmacy decides to ban this herb.
This pending legislation holds the fate of kratom in Virginia. However, some alternatives could be introduced that may save kratom from becoming banned. The Kratom Consumer Protection Act was put together by the American Kratom Association and the Botanical Education Alliance. These organizations hope to get every state on board with this act, as it will regulate the kratom industry. The act will address several issues, including:
- Clearly labeled ingredients
- That the sale or transfer possession of any kratom to another person under 18 years of age is prohibited
- The amount of mitragynine and 7-hydroxymitragynine contained in the product be listed
- The amount of mitragynine and 7-hydroxymitragynine contained in the packaging be listed
- The common or usual name of each ingredient used in the manufacture of the kratom product, listed in descending order of predominance
- The name and the principal mailing address of the manufacturer or the person responsible for distributing the kratom product
- Clear and adequate directions for the consumption of kratom the product necessary for its safe and effective use
- Any precautionary statements as to the safety and effectiveness of the kratom product
Is Kratom’s Legal Status In Jeopardy?
From a nationwide standpoint, no, kratom’s legal status is not in jeopardy. Kratom is not regulated at a federal level and there is no sign of this happening in the near future. So, each state must make its own decision when it comes to offering kratom in its state. It is important that you state current on the laws and offer your support when it is needed.
